When most people think about cannabis, they think it’s illegal. So are hemp and hempseeds legal in Germany?
In general, cannabis seeds are legal in Europe. Each country has its own rules, even if cannabis is an illegal substance, the supply, storage and import of hemp seeds is allowed.
Although cannabis seeds fall under the German narcotics law, they are only illegal if they are used for cultivation. In itself, Germany is the only European country that prohibits the sale of hemp seeds. In the EU the principle of the free sale of goods prevails, therefore products may be sent to Germany. Means: Whoever orders hemp seeds in Germany is NOT liable to prosecution.
ARE CANNABIDIOL (CBD) PRODUCTS LEGAL?
CBD products are quite unknown in Germany, but their healthy effect is slowly becoming a trend. As long as these products do not exceed the THC content of 0.2%, it is okay according to law. CBD can be purchased as a dietary supplement, in cosmetic products and for your little four-legged friends.
CBD is considered non-psychoactive by the legislator and is therefore no longer subject to the narcotics Law.
Cannabinoid is regarded as a dietary supplement. This classification allows CBD oil to be purchased legally. This also applies to CBD, which is sold in cosmetics. These classifications must be observed when purchasing CBD. If the product is sold as a remedy or medicine with reference to special effects, this is to be classified as illegal. From a rational point of view, the prohibition of promises of cure is very sensible: CBD is not a panacea but only a natural component of the hemp plant.
In Germany cannabis seeds are subject to the narcotics Law
According to Section I, Paragraph I, of Annex I to the Narcotics Law, it is stipulated that hemp seeds are also covered by the Narcotics Law. The reason for this is that not only marijuana may not be possessed or traded, but also the possession of parts of the plant is prohibited. Seeds are undoubtedly a part of the marijuana plant and therefore fall under the Narcotics Law. This also applies if the cannabis seeds are no longer germinable.
Why then do people own hemp seeds?
However, there is a special regulation that says that you may own hempseeds if you do not cultivate them. So you can order cannabis seeds from other European countries where the trade and possession is completely legal. The problem is, the judge will not always believe that you did not intend to plant the seeds. You can also be sure that you will be searched if the cannabis seeds are intercepted by post.
Industrial hemp does not fall under the Narcotics Law!
Industrial hemp, which contains little or no THC and is further processed as oil, animal feed or food, does not fall under the Narcotics Act. Nevertheless, as a private individual in Germany, you are not allowed to cultivate hemp – regardless of whether it is a female or male plant.
The ban on cultivation in 1995
The cultivation of hemp in Germany was completely prohibited between 1982 and 1995 in order to prevent the use of cannabis as a narcotic. The THC content in hemp is hardly detectable (usually less than 0.3 percent) and is therefore uninteresting for cannabis users anyway. Since 1996, companies in agricultural enterprises have been allowed to grow hemp again, private individuals are excluded. Textiles made of hemp are experiencing a long overdue revival – and there are many good reasons for this.
Fun fact: The consumption of cannabis is legal in Germany! However, it can happen very quickly that only the holding of cannabis products, such as a joint, can be seen as possession.
